The man who allegedly confronted NBC News’ Shaquille Brewster during a live shot has been found and arrested.

Benjamin Eugene Dagley, 54, was apprehended in a strip mall in Dayton, Ohio, authorities say.

Dagley is facing two counts of assault, one count of disturbance of the peace and one count of violation of emergency curfew in Gulfport, Mississippi where the alleged incident, which was almost completely documented on live TV, took place.

Brewster was on scene covering the aftermath of Hurricane Irene when Dagley could be seen driving up behind the camera position, exiting his vehicle and walking toward Brewster and his crew, who were broadcasting live on MSNBC.

The camera swung around in an attempt to block Dagley’s appearance, and he can be heard continuing to yell in the background before he appears to charge at Brewster, who could be seen putting him arm in defense just before the network cut away.

In addition to the Gulfport charges, Dagley could be facing additional legal problems because it appears he may have allegedly violated a probation order by traveling out of state, though charges on that have not been filed.

Dagley was booked in the Montgomery County jail in Ohio. It’s not clear if he has an attorney for this case or if he will be extradited to Mississippi. He has also not entered a plea, and therefore it’s unlikely any decision as to bail or bond would have been made, as of publication time.

Dagley’s potential probation problems stem from a 2017 incident that he pled guilty to the charges of vandalism, inducing panic and attempted assault.

Court records show he was ordered to pay a $5,000 fine and $10,000 in restitution to a company called Cleveland Plating. He was also sentences to five years’ probation and 30 days in jail.
